1. Agreement to Terms
Welcome to SKYANA. By accessing or using our website located at skyanawellness.com, purchasing any digital products, or enrolling in any courses or programs offered by SKYANA, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, do not access or use our services.
These Terms constitute a legally binding agreement between you (“User,” “you,” or “your”) and SKYANA (“Company,” “we,” “us,” or “our”). We reserve the right to update or modify these Terms at any time. Continued use of our services after any changes constitutes your acceptance of the revised Terms.
2. Description of Services
SKYANA provides the following educational services:
CNA (Certified Nursing Assistant) exam preparation materials including practice questions, flashcard sets, and skills guides
Downloadable PDF study materials, question banks, and ebooks
Online instructional content and video-based review sessions
Mock exams, competency assessments, and skills checklists
Community access and peer study resources
All content is intended solely for educational purposes. SKYANA does not guarantee passing scores on any state or national CNA licensing examination. Passing any exam is dependent on the individual student’s preparation and performance.
3. Eligibility & User Accounts
You must be at least 18 years of age, or the age of majority in your jurisdiction, to create an account or purchase products. By creating an account, you represent and warrant that:
All registration information you submit is truthful and accurate
You will maintain the accuracy of your account information
You are solely responsible for maintaining the confidentiality of your password
You will notify us immediately of any unauthorized use of your account
One account per person; account sharing is prohibited
We reserve the right to terminate accounts, refuse service, or remove content at our sole discretion, including for violations of these Terms.
4. Intellectual Property Rights
All content on the SKYANA platform—including but not limited to text, questions, rationales, graphics, logos, PDFs, audio, video, and course materials—is the exclusive intellectual property of SKYANA and is protected by U.S. and international copyright, trademark, and other intellectual property laws.
You may NOT:
Reproduce, copy, distribute, or republish any SKYANA content without prior written consent
Sell, sublicense, or transfer any materials to third parties
Remove or alter any copyright, trademark, or proprietary notices
Use our content to create competing products or services
Screen-record, scrape, or bulk-download any platform content
You MAY:
Download and print materials purchased for your personal, non-commercial study use only
Share materials with a study group of no more than 3 individuals, provided no compensation is exchanged
5. Purchases, Payments & Refund Policy
All prices are listed in U.S. dollars. By completing a purchase, you authorize SKYANA to charge the applicable fees to your selected payment method. We use third-party payment processors (such as Stripe or PayPal) and do not store your full credit card information.
Digital Products (PDFs, Ebooks, Flashcards): Due to the nature of digital downloads, all sales of digital content are final and non-refundable once the download link has been accessed or the file delivered. If you experience a technical issue preventing access, contact us within 48 hours at skyana1985@gmail.com and we will work to resolve it.
Courses & Memberships: Course enrollments may be eligible for a full refund within 7 days of purchase, provided you have not completed more than 20% of the course content. After 7 days or 20% completion, no refunds will be issued. Subscriptions are billed on a recurring basis and may be cancelled at any time; cancellation takes effect at the end of the current billing period.
SKYANA reserves the right to modify pricing at any time. Promotional prices are time-limited and subject to change without notice.
6. Prohibited Conduct
You agree not to engage in any of the following:
Using our services for any unlawful purpose or in violation of any applicable federal, state, or local law
Attempting to gain unauthorized access to any portion of our platform or related systems
Uploading or transmitting viruses, malware, or any destructive code
Harassing, threatening, or defaming any other user, employee, or representative of SKYANA
Impersonating any person or entity, including SKYANA staff or instructors
Collecting or harvesting user data without authorization
Using any automated tools (bots, scrapers, crawlers) to access our platform
Posting false, misleading, or deceptive content or reviews
7. Disclaimer of Warranties
OUR SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SKYANA DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.
SKYANA makes no guarantee that any student will pass the CNA certification examination or achieve any specific outcome as a result of using our materials. All practice questions and content are for educational purposes only and are not sourced from or affiliated with any official testing body such as Pearson VUE or PSI.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SKYANA AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL ARISING FROM YOUR USE OF OUR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
In no event shall SKYANA’s total cumulative liability to you exceed the greater of (a) $100 USD or (b) the total amount you paid to SKYANA in the twelve (12) months preceding the claim.
9. Indemnification
You agree to indemnify, defend, and hold harmless SKYANA and its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of our services; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit to the platform.
10. Third-Party Links & Services
Our platform may contain links to third-party websites or integrate third-party tools (e.g., payment processors, analytics). These links are provided for convenience only. SKYANA has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party services. We encourage you to review the terms and privacy policies of any third-party service you use.
11. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-law provisions. Any dispute arising from these Terms shall be resolved exclusively in the state or federal courts located in Florida.
Before initiating any legal proceeding, you agree to contact SKYANA at skyana1985@gmail.com to attempt informal resolution. Both parties will make a good-faith effort to resolve the dispute within 30 days.
12. Termination
SKYANA reserves the right to suspend or terminate your access to all or part of the platform at any time, with or without notice, for conduct that violates these Terms or is harmful to other users, SKYANA, or third parties. Upon termination, your right to use the platform ceases immediately.
